Mississippi Mayor Bans Open Carry, State AG Says No

 In 2nd Amendment

Jackson, Mississippi Mayor Chokwe Lumumba banned open carry in the city using the same tired excuse of all left wing gun grabbers: just ‘trying to save lives.’ It’s a statement that shows an extreme agenda and MS Attorney General Lynn Fitch called him on it in a letter:

“The Governor’s Proclamation does not authorize you to suspend the right to open carry, or any other statute or constitutional provision governing firearm possession. While the Order seeks to suspend the “open carry of firearms,”  it does not identify any specific statute or statutes that it seeks to suspend. The right to keep and bear arms is a natural right, enshrined in the Constitutions of the United States and the State of Mississippi. In an effort to provide safeguards to the diminution of this right, the Mississippi Legislature has imposed strict limitations on a municipality’s authority to regulate ‘the possession, carrying, transportation, sale, transfer or ownership of firearms or ammunition or their components.’  Further, in addition to the Attorney General’s broad authority to see that Mississippi’s laws are properly enforced, the Legislature has charged my office with ensuring local governing authorities do not exceed their statutory power to restrict certain firearm possession.” Mississippi AG Lynn Fitch

Of course, Lumumba used the emotional arguments of all anti-gunners for trying to “remove illegal weapons.” Which is false advertising. If it was just for “removing illegal weapons” it wouldn’t be a ban on all open carry. They’d target criminals.

Oh yes, suspending the Constitutional rights of the citizens is just to “keep people safe.” Why hasn’t crime gone down all over the country in large cities? Because criminals don’t give a rip about lockdown orders or social distancing.

Prior to 2013, there was no open carry law in Mississippi. What they have now is a bill signed by former Gov Phil Bryant that said the state has no authority to “regulate or forbid” open carry. Only the state legislature has the ability to regulate firearms – and the city of Jackson is not the state legislature.

One Twitter user named Ben mentioned:

The “desire to open carry” in Jackson, Mississippi is because @TheDemocrats have not lifted a finger to cut down violent crime in over 5 decades. As the city continues to fall into ruin, we should ask, “Who was the last Republican mayor?”@CityofJacksonMS  has been held hostage.

The Mississippi AG called the order illegal, unconstitutional and told him to rescind the order immediately. There may be a lawsuit in the wings also from Second Amendment advocates.

The Mayor’s office claims that the city attorney vetted the order and found it sound, but attorney Thomas Payne says it’s “unconstitutional and illegal.” (Clarion Ledger)

Jackson’s Mayor is a community organizer (where have we heard that before) who has this note on his political resume:

“He currently serves as the media representative of the Coalition for Economic Justice and is an active member of the Malcolm X Grassroots Movement. His talent for organizing has been a vital component to previous city elections.”

A “vital component” to destroy the rights of citizens.

“The mayor is way off-base and I am confident there will be a quick legal fix to the circus he has created. Guns are not the problem. Criminals are the problem and they couldn’t care less about his executive order.” Retired Police Officer, firearms instructor and gun-rights advocate Rick Ward
