Democrats Boycotted ACB, Republicans Move Her to Senate Floor Anyway
Today was the planned vote to move ACB, Amy Coney Barrett, out of the Judiciary committee. Democrats boycotted the vote. No Democrats showed up, and they placed pictures of people who are “dependent on Obamacare” on their chairs. But 12 GOP Senators unanimously voted to send her out of committee and onto the Senate Floor for a Monday vote on confirmation.
Changing up the rules
“Under the committee rules you need two members of the minority to conduct business. But they’re intentionally denying us that participation. They’re boycotting the committee. So what I will do as chairman there will be a majority of the committee present. We will waive that rule. We will report Judge Barrett out. She will go to the floor. And hopefully, by Monday or Tuesday, she will be on the court.” Sen Lindsey Graham

Senate Rule XXVI.7(a)(3) says that “The vote of any committee to report a measure or matter shall require the concurrence of a majority of the members of the committee who are present.” But the rules of the Judiciary Committee go farther, saying that “Nine Members of the Committee, including at least two Members of the minority, shall constitute a quorum for the purpose of transacting business.”
The Judiciary Committee rules add that nominations cannot be reported “unless a majority of the Committee is actually present at the time such action is taken and a majority of those present support the action taken.” Committee business has been transacted without minority members multiple times in the past, including in 2014 when Democrats took similar action to what Republicans took today with lower court judges. Committees have discretion over their own rules as long as their actions do not conflict with Senate rules.
Graham basically decided to override committee rules because it didn’t conflict with Senate rules.
Democrats know full well that she is an excellent choice for the Supreme Court, and her accomplishments are exceptional. But they have politicized her nomination so strongly, calling it “illegitmate” (which is it not) in an effort to blame the President once again. They don’t like that she is a Conservative. But then, Democrats hate Conservatives.
During the hearings, Democrats attacked ACB, demanding to know how she will vote on issues she has not heard before the court. In other words, they are trying to be “thought police.” Demanding that she tell them how she will rule before she’s even heard the cases is egregious behavior. They believe she will overturn the ACA (Obamacare) and possibly Roe v. Wade.
But as with Chief Justice John Roberts, we do not know how she will rule on the issues until she actually does. We thought Roberts was a Conservative, but he has ruled with liberals several times, including a recent case allowing Pennsylvania to add three days to their ballot count. Even RBG actually voted with Conservatives on occasion…very few occasions, but once in a while.
An honest judge is the most important judge – Amy Coney Barrett shows herself as honest, and stands for the truth in all cases she has decided with the 7th Circuit Court. We trust in her wisdom and character. And she deserves to be on the Supreme Court.
